Commercial Rent Disputes with a Delta backdrop

An area fraught for property professionals, we again delve into ADLS Lease Clause 27.5 which allows for an abatement of rent and outgoings in the event of an emergency if the tenant is unable to fully conduct business from the premises they occupy.

This clause was drafted as a result of the Canterbury Earthquakes when many tenants were unable to access their premises due to their businesses being “cordoned off”.

Gregory Allen and Will Barnes from Simpson Grierson explore this clause in the new ‘Covid context’ with useful advice and suggestions on how to avoid unnecessary complications.
